§ 1 Provider and scope

(1) These Terms of Service (Terms) apply to all orders that you place as a consumer or business through our online shop hushhourcosmetics.com.

(3) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).

§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order.

(2) By clicking the “Buy” or “Buy now” button, you submit a binding offer to purchase the goods in your shopping cart.

(3) The contract is concluded as soon as we accept your offer by sending an order confirmation by email or by dispatching the goods. An automated order receipt does not yet constitute acceptance.

(4) The contract text is stored by us. You will receive the contract text by email.

§ 3 Prices and shipping costs

(1) All prices include statutory VAT, unless otherwise indicated.

(2) Shipping costs may apply in addition to the prices shown. The exact shipping costs and, where applicable, the threshold for free shipping are displayed during the order process and on the “Shipping & Delivery” page.

§ 4 Payment

(1) The payment methods offered during the order process are binding. Available methods typically include credit card, Apple Pay / Google Pay, Klarna, PayPal, and SEPA direct debit.

(2) The purchase price is due for payment immediately upon conclusion of the contract, unless otherwise agreed.

§ 5 Delivery

(1) Delivery is made to the address you specify. We currently ship worldwide.

(2) Standard delivery times after conclusion of the contract: 2–4 business days in Germany, 6–8 business days within the EU, 7–10 business days to the United States, and 7–14 business days for other international destinations. Specific delivery times can also be found on the respective product page and on the “Shipping & Delivery” page.

(3) If a product is unavailable, we will inform you immediately and refund any payments already made.

§ 6 Retention of title

The delivered goods remain our property until full payment.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our withdrawal policy. You can find the full withdrawal policy and the model withdrawal form here.

§ 8 Liability for defects

The statutory rules on liability for defects apply (§§ 434 et seq. BGB). The limitation period for claims based on defects is two years from delivery of the goods.

§ 9 Dispute resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 10 Applicable law

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is a consumer with habitual residence abroad, mandatory consumer protection provisions of the respective state of residence remain unaffected.
